Any dispute, controversy, claims or disagreement of any kind whatsoever arising out of or in connection with these Terms of Use or Privacy Policy (or the breach, termination or invalidity thereof) or the Website or App or any products or services sold using or through the Website or App (hereinafter referred to as a “Dispute”) shall be exclusively referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be held in Mumbai, India and the Arbitral Tribunal shall consist of a sole arbitrator appointed by the Mumbai Centre for International Arbitration. You waive/s any and all objections to the exercise of jurisdiction over you by such an arbitrator. The arbitrator’s decision shall be reasoned, in English, final and binding on you and M&M. Subject to the above, the courts in Mumbai, India shall have exclusive jurisdiction over such Disputes.

No waiver by M&M of any term or condition set forth in these Terms of Use or Privacy Policy shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of M&M to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

The Terms of Use, the Privacy Policy, the Terms and Conditions for Explore the Impossible Activities, and any other terms and conditions that you may be required to agree before or during the use of the Website or App constitute the sole and entire agreement between you and M&M with respect to the Website or App and the products or services purchased from the Website or App and supersede all other understandings, agreements, representations and warranties, both written and oral, with respect to the Website and App or any of the purchases.
